Terms and Conditions

Estimates & Quotations

Estimates and quotations is valid for 30 days from the date specified. It is your responsibility to ensure that your requirements are completely covered in the estimate. Acceptance of the estimate which includes these terms and conditions must be confirmed in writing or by email. Any amendments to this estimate must be submitted in writing and agreed by both parties prior to work commencing. In some cases a new estimate will be required.

Payments

On receipt of written acceptance of this estimate an invoice will be generated for a non-refundable 50% deposit payment which must be cleared in our bank account before work commences. The remaining 50% of the cost is payable prior to completion of the work and the deposit payment will be subtracted from this invoice.

If an invoice is not paid by the date it is due a charge of 10% of the amount owed will be added per week until the payment has been received and cleared in our bank account.

Receipt of all payments will be confirmed in writing or by email.

Please note that we are not VAT registered, therefore prices do not include VAT. An invoice can be supplied for your accounting purposes but this will not be a VAT invoice.

Cancellation

If you wish to cancel at any point after work has begun, you will need to give us written notice. Payments that have already been made to us are non-refundable and refunds are not available. If applicable an invoice will be generated for costs of any completed or outstanding work.

Web hosting and domain name registration

This estimate is not inclusive of costs for web hosting or registration of domain names as this is not a service that we provide. If you require these services a separate payment will need to be made directly to a third party providing company. We can offer advice, suggestions and obtain estimated pricing from relevant third party companies. In most cases we are able to work with these companies on your behalf with prior consent.

In order to commence with any work, full access to relevant systems, web hosting and domain name services will be required.

Working with you

All work is completed outside of standard office hours, during evenings and weekends. We always try to respond to correspondence in a timely manner but in some circumstances such as annual leave and personal commitments this could lead to slightly longer response times. Our work completion estimates take this into consideration and we always do our best to inform you when a delay in correspondence is likely.

Copies of work

If you require a copy of the work produced, this can usually be supplied by a temporary downloadable link at the cost of £5.00. Any alternative methods for delivering the work and the additional costs involved will need to be agreed in writing by both parties.

Estimated completion times

The estimated completion time is based on an initial assessment of the work required. In some cases when unknown circumstances arise or further complexity is discovered that was not originally visible, the completion time may increase. We do our utmost to prevent this from happening, but in the rare case that work might take longer than originally scoped we will discuss this with you at the earliest opportunity and look at other potential options.

It is also important that agreed project requirements along with any media or content are supplied prior to work commencing as any delays can increase the estimated completion time.

Content and requirements

It is your responsibility to supply all content such as text and images. You must ensure that we are not delayed as a result of late delivery of the content required to complete your website. On any occasion where we are delayed for over 10 working days due to content not being provided or essential information required to complete your project, we reserve the right to impose a surcharge of 20% of the total cost of the work or invoice the cost of the entire project in advance.

Liability and limitations

You must have the appropriate copyright licenses and usage rights for any media and content used. We do not accept any responsibility or liability for legal issues or disputes caused by copyright breaches or misuse of media and content.

We accept no responsibility or liability for any breach of data, loss of personal information or any costs incurred or associated with legal action or dispute. Once work has been signed off and handed over, the website is owned by you and you are completely responsible for the security of your website and the appropriate treatment of personal data as well as any data held by third party companies in relation to your website.

We accept no responsibility or liability for the status of third party domain name or web hosting providers and any losses that occur due to outages or downtime. In the case of any outages or downtime we are able to offer assistance in liaising with the companies involved to attempt to resolve the situation. Prices for this assistance will be discussed and confirmed in writing or by email.

We design and build websites in accordance to your specifications. It is your responsibility to ensure that the website and its content comply with current online trading laws and regulations. We are not responsible for any failure to comply with laws and regulations related to accessibility, selling online or those related to a specific business or trade.

The order in which websites are ranked in natural search results is controlled by search engines (such as Google). While we optimise your site in order to make it friendly for search engines to index, it is impossible to make any guarantees on ranking position.

Sign off and hand over of work

We take great pride in the quality of work we produce. We test all of our work extensively and only when we are happy will we require your sign off in writing or by email against the agreed scope of work in order to hand it over. Unless otherwise agreed, an invoice will be generated at this stage for payment of the balance within 30 days.

In the rare event that you find an issue after the work has been signed off and handed over we can provide a new estimate to work on a solution. Of course if the issue is an error on our part there will be no costs involved in resolving it and a completion time will be agreed in writing or by email by both parties.

Maintenance options

Once work has been signed off and handed over or if you have an existing website, we have a range of maintenance plans covering occasional fresh content to regular monthly updates. Details can be provided on request.
